Strut Your Fluff Photo Contest Official Rules

All federal, state and local laws and regulations apply; void where prohibited.

ELIGIBILITY

The Contest is open only to individuals, who are U.S. Residents and 18 years or older at time of entry. Employees of Diaper Lab and their immediate families are ineligible.

TO ENTER

You may submit up to ten (10) cloth-diaper related photos which best represent the Contest theme of "Strut Your Fluff." Entries must be submitted via the Diaper Lab Community Website (registration required to upload and submit photos to this Contest). Follow the instructions posted at http://www.diaperlab.com/connect/contest.php in particular by labeling/tagging your photo whit the term "contest". Unlimited photos may be uploaded to the Diaper Lab Community site, but no more than 10 may be labeled "contest"; posting of additional pictures so labeled my disqualify you from this Contest. Preferred photo resolution is a maximum edge size of 1024px, though pictures of different dimensions will not be disqualified. By labeling/tagging your photo with "contest" you agree to abide by all terms and conditions outlined here for the Contest. Entrants are required to provide their name and e-mail address to participate. All information provided by entrant must be complete, true and correct. Submissions to the Contest must be uploaded by 8pm EDT on November 4, 2009 in order to be eligible; entries uploaded after that date will be deemed ineligible to win. All entries may be used by Diaper Lab, whether selected for a prize or not. Nothing in these Contest rules obligates Diaper Lab to publish or otherwise use any photos submitted in connection with the Contest. Each entry must be submitted on an individual basis (i.e., no team, joint, or corporate entries) and all components of the entry must be the original creation of the submitting participant. Only non-commercial work may be submitted. Entries may not contain illegal material, or material that violates the rights of third parties. Entries containing any forbidden matter or material otherwise deemed by Diaper Lab to be inappropriate will be disqualified.

JUDGING

Diaper Lab will select winning entries based upon the criteria of originality, visual impact, and relevance to cloth diapers and the "Strut Your Fluff" contest theme. The "People's Choice" award will be selected from a subset of photos selected by Diaper Lab as above, then evaluated by site visitors who decide to participate in the rating of photographs; no claim is made that such evaluation and voting is monitored or explicitly restricted to prevent irregularities in how votes/evaluations are made, tabulated or registered by the system. By entering, you agree to be bound by these Official Rules, and that the decisions of the judges are final and binding in all respects. Judging will be completed by November 14, 2009, and potential winners will be notified by e-mail on or before November 28, 2009. Based upon the content of submissions, Diaper Lab reserves the right not to select any winning submissions. Potential winners will be required to sign and return a sworn Affidavit of Eligibility and Liability and Publicity Release. If required documentation is not returned within seven (7) business days of notification, or if notification is returned as undeliverable, any prize will be forfeited and an alternate winner may be selected.

PRIZE AWARDS

Prizes will be awarded within thirty (30) days after winner verification. No prize substitution or transfer is permitted, except that Diaper Lab reserves the right to substitute a prize of equal or greater value for any reason. All taxes, fees and any other incidental expenses on Prizes are the sole responsibility of each winner. In the event selected winners can not be contacted or fail to accept or acknowledge the award within fourteen (14) days of initial attempt at notification to their submitted e-mail address, Diaper Lab may, at its discretion, withdraw the award prize or select an alternate winner.

PEOPLE'S CHOICE VOTING

Voting for the "People's Choice" award is limited to one vote or set of evaluations per person. Creation of multiple accounts, personalities, or other means to register more than one set of votes, evaluations, or reviews of pictures by a single individual will disqualify and void all such entries by that individual.

GENERAL RULES & LIMITATIONS

By entering, you represent that: (i) your entry is your own original work; and (ii) you own or have the rights to convey any and all right and title in any material submitted as part of your entry into the Contest. By entering, you grant to Diaper Lab a non-exclusive, worldwide, royalty-free license to edit, publish, promote, republish at any time in the future and otherwise use your submission, along with your name and likeness, in any and all media for possible editorial, promotional or advertising purposes, without further permission, notice or compensation (except where prohibited by law). Additional Terms of Service for use of the Diaper Lab Community Site also apply (see http://community.diaperlab.com/service/displayTOS.kickAction?as=135881). Only uploaded pictures labeled "contest" (regardless of number) are subject to the terms and conditions of this Contest, though other Terms of Service for use of the Diaper Lab Community Site still apply (see above link). Participants who are semi-finalists and whose work is chosen to be voted upon for the People's Choice award may not attempt to influence the outcome of the contest through fraudulent means, including but not limited to such actions as multiple voting by a single individual; payment or payment-in-kind to other individuals in exchange for votes; or by enticing or directing other individuals to vote multiple times in violation of contest rules; any semi-finalist who fails to comply may be disqualified without redress or appeal. By participating in the Contest, you agree to release Diaper Lab and its affiliates, employees, owners, and agents from any and all liability, claims or actions of any kind whatsoever for injuries, damages or losses to persons and property which may be sustained in connection with the receipt, ownership, possession, use, or misuse of any prize. Diaper Lab is not responsible for technical, hardware or software failures, or other errors or problems which may occur in connection with the Contest, whether computer, network, technical, mechanical, typographical, printing, human or otherwise, including, without limitation, errors or problems which may occur in connection with the administration of the Contest, the processing or judging of entries, the announcement of the prizes, in any Contest-related materials, or that may limit prize fulfillment or a participant’s ability to enter the Contest. Diaper Lab reserves the right to amend these official rules and to permanently disqualify from the Contest any person it believes has intentionally violated these official rules.
